Labor & Employment

Sanchez Law offers a variety of services related to labor and employment, specializing in illegal dismissal cases, and complaints filed before the National Labor Relations Commission (NLRC).

The attorney can assist corporations and employers in two significant phases on matters relating to Labor and Employment:

  1. Policy making and pre-dispute matters.

Prudent employers know that their respective human resource policies and handbooks must comply with the Labor Code; otherwise, they assume the risk of costly litigation before the NLRC if their employee files a complaint. Their disciplinary standards and procedures must be clearly outlined, and must be enforced in a manner that is consistent by the Labor Code. Furthermore, their policies must harmonize with other laws that affect employees such as the Data Privacy Act, the Social Security Law, the Paternity Leave Act, the Solo Parents’ Welfare Act, the Magna Carta for Women, the Expanded Maternity Leave Act, etc.

Sanchez Law is available to formulate human resource policies, edit and update existing ones, and brief employers on how to properly execute the necessary policies.

  1. Legal Representation in Disputes.

Employees usually file complaints before the NLRC for a myriad of reasons: unobtained benefits, money claims, disciplinary and termination issues, etc. Sanchez Law is prepared to represent employers in hearings, and to file Position Papers, Replies, Appeals, Motions for Reconsideration before the NLRC, and further appellate matters to the Court of Appeals and the Supreme Court.

Sanchez Law also offers its service to employees to represent them before the NLRC to file complaints that necessarily relate to labor matters, ie. employment and termination, benefits, money claims, etc.
